Short-Term Rental Agreement & House Rules

Thank you for choosing to stay with us. These Terms & Conditions govern all direct bookings made through Casita on Fifth. By completing a reservation, submitting payment, or accessing the property, you agree to comply with the terms outlined below.

1. Parties to the Agreement

Guest:
The individual(s) completing the booking and all occupants associated with the reservation.

2. Premises

The Guest is granted a temporary, revocable license to occupy the furnished residential property identified in the booking confirmation (the “Premises”) solely for short-term lodging purposes. This license does not create a tenancy or leasehold interest.

3. Occupancy Term

The occupancy term begins at the confirmed check-in date and time and ends at the confirmed check-out date and time stated in the booking confirmation.

Check-in begins at 4:00 PM.
Check-out is at 10:00 AM.

4. Occupancy Limits

Only the number of guests listed in the booking confirmation may stay overnight. Unauthorized guests are not permitted and may result in additional charges or immediate termination of the stay without refund.

5. Quiet Hours & Conduct

Quiet hours are from 10:00 PM until sunrise. Guests agree to behave respectfully and avoid excessive noise, disruptive behavior, or conduct that disturbs neighbors or surrounding residents. Parties, events, or gatherings are not permitted at any time.

6. Noise Enforcement

Noise disturbances may be identified through neighbor complaints, Host observation, or other reasonable means. The property may utilize noise-monitoring devices that do not record audio. Tampering with monitoring devices is prohibited.

7. Fees, Charges & Deposits

All booking charges, cleaning fees, taxes, and any applicable security deposit are disclosed during the booking process. Any security deposit may be used to cover damages, excessive cleaning, rule violations, or additional labor required and will be returned in accordance with Florida law, less any lawful deductions.

8. Pet Policy

Pets are not permitted on the Premises. Service animals are permitted as required by law. Unauthorized animals may result in additional cleaning, damage charges, or other applicable fees.

9. Smoking Policy

Smoking or vaping is strictly prohibited inside the Premises. Smoking is permitted only in designated outdoor areas, if applicable. Evidence of indoor smoking may result in additional cleaning or remediation charges.

10. Use of Premises

The Premises may be used for residential lodging only. Commercial activity, illegal use, or any activity violating local, state, or federal law is prohibited.

11. Maintenance, Furniture & Condition

Guests agree to maintain the Premises in good condition and to use all furnishings, fixtures, and appliances responsibly. Furniture, décor, and household items must be returned to their original placement prior to checkout. Damage beyond normal wear and tear may result in charges.

12. Checkout Procedures

Checkout instructions are provided via Boarding Pass. Failure to follow reasonable checkout procedures may result in additional charges only if extra work beyond standard turnover is required.

13. Additional Charges for Rule Violations

Additional charges may be assessed only to recover actual costs incurred, including but not limited to excessive cleaning, smoking violations, unauthorized pets, unauthorized guests, noise disturbances requiring intervention, late checkout without approval, or furniture moved and not returned to its original placement. All charges are subject to documentation.

14. Identity Verification

Identity verification is required for all direct bookings. Failure to complete identity verification within the required timeframe may result in cancellation without refund.

15. Parking

Parking availability and restrictions are disclosed in the listing description. Unless explicitly stated otherwise, driveway access is not included. Vehicles parked in restricted areas or blocking access may be towed at the vehicle owner’s expense.

16. Cancellation Policy

Cancellations made 30 or more days before check-in receive a full refund.
Cancellations made 14 to 29 days before check-in receive a 50 percent refund.
Cancellations made within 14 days of check-in are non-refundable.

For bookings made less than 30 days before check-in, the policy applies based on the remaining time prior to arrival.

17. Early Termination

Violation of these Terms & Conditions may result in immediate termination of the stay without refund.

18. Liability & Indemnification

Guests assume responsibility for personal injury, loss, or damage arising from use of the Premises and agree to indemnify and hold harmless the Host from related claims. The Host’s insurance does not cover Guest personal property.

19. Personal Property

The Host is not responsible for items left behind. Reasonable efforts may be made to return items. Unclaimed items may be disposed of in accordance with Florida law.

20. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.

21. Acknowledgment

By completing a booking, submitting payment, or accessing the property, the Guest acknowledges that they have read, understand, and agree to these Terms & Conditions.
